$9.5 Million Awarded in Cruise Ship Slip-and-Fall

A Miami-Dade Circuit Court jury has awarded a British fitness instructor $9.5 million for injuries suffered when he slipped and fell on the wet floor of a spa on Norwegian Cruise Line's Norwegian Crown reports the Miami Herald.

The 42-year-old man alleged he sustained a back injury in the 2006 fall and as a result became incontinent and impotent. The jury award will cover damages for economic losses, medical expenses, and past and future pain and suffering.

The defendant who is the operator of the spa strongly believes it is not responsible for the injuries and has filed papers seeking a new trial or a reduction of the jury award. The Miami based Norwegian Cruise Line settled out of court.

$1.5 Million Paid In Cell Phone-Caused Vehicle Crash

The Palo Alto Daily News reports the city of Palo Alto will pay $1.5 million to a man injured in a vehicle crash in 2006. The victim alleged a city worker failed to stop for a red light because he was reaching for his cell phone, resulting in a rear-end collision which left the plaintiff with debilitating spinal injuries. The victim had asked for more than $5 million from Palo Alto.

This is the largest payout for the city for a personal injury claim in recent history. The driver of the city vehicle is no longer employed by the city.

$7 Million Awarded To Woman Hit By Metro Van

The Seattle Times reports King County has agreed to pay what is believed to be the largest amount the county has ever paid a single plaintiff - $7 million to a woman hit by Metro van.

In November 2007, the woman was riding her Vespa scooter to work as an operating room nurse when she was struck by the Metro van. The driver failed to yield the right of way at a stop sign.

The impact with the van caused the woman to be thrown 40 feet, suffer severe internal injuries and compound leg fractures. She was in a coma for several days following the accident and has not been able to return to work.

BP Ordered To Pay $100 Million To Workers Exposed To Toxic Materials

KWTX reports a federal jury in Texas awarded 10 workers $10 million each in punitive damages after being injured at BP PLC's Texas City plant.

In the lawsuit the workers claimed the BP plant released a toxic substance which caused their injuries. More than 100 workers were sent to area hospitals in April 2007, claiming they were exposed to the toxic substance released by the refinery.

BP officials deny the workers were harmed and are said to be shocked by the verdict.

Father Sues Harvard College In Son's Death

Bloomberg reports a father of a Harvard College student has sued the college and fellows over his son's suicide in 2007. Harvard College is the undergraduate school of Harvard University.

The wrongful death lawsuit brought on behalf of the student's estate claims Harvard's health service prescribed drugs known to increase suicide risk and other side effects.

At the time of his death, the student was taking Accutane for cystic acne, Adderall for attention deficit hyperactive disorder (diagnosed by the school nurse) and Prozac for an anxiety disorder (also diagnosed by the nurse) and Wellbutrin, which also contains warnings about suicide for patients under age 25. The nurse allegedly signed the prescriptions for the drugs as a doctor.

Roche Laboratories stated in June it would pull Accutane off the U.S. market because of the reports of depression and suicide in patients. A 2004 FDA report suggested antidepressants such as Prozac and Wellbutrin might double the suicidal thoughts and actions in children and teens.

The student was valedictorian of his high school class.

$8 Million Awarded In Transit Bus Personal Injury Suit

A 34-year-old research librarian has been awarded $8 million by a Richmond, Virginia jury for injuries she suffered when struck by a GRTC Transit System bus in 2007, reports the Richmond Times-Herald.

The librarian suffered spinal and shoulder damage as well as hip and pelvis fractures when she was struck by the bus which made a right hand turn as she was crossing the street beside the Library of Virginia. She will probably need multiple hip replacement surgeries before she turns 50-years-old.

The bus company originally offered a $1.8 million settlement. The $8 million awarded was the full amount requested in the case.

Parents of 10-Year-Old Awarded $22.3 Million In Medical Negligence Lawsuit

The Chicago Sun-Times reports a Cook County jury has awarded the parents of a 10-year-old boy $22.3 million in a medical negligence case that resulted in the loss of the boy's leg shortly after his birth.

The young boy was born in May 1999 with a congenital heart defect which required a shunt procedure performed at Advocate Christ Medical Center/Hope Children's Hospital in Oak Lawn, Illinois. Two weeks after being sent home, the parents returned the infant to the emergency room.

The lawsuit alleged his left leg had to be amputated due to mistakes made in the operating room. The child also suffers from cognitive deficiencies and developmental delays alleged to be caused by the delayed treatment and cardiac catheterization.

The jury found the hospital and staff were negligent in failing to diagnose the infant's shunt problems in time and subjecting him to an unnecessary catheterization.
