Parents of 10-Year-Old Awarded $22.3 Million In Medical Negligence Lawsuit

The Chicago Sun-Times reports a Cook County jury has awarded the parents of a 10-year-old boy $22.3 million in a medical negligence case that resulted in the loss of the boy's leg shortly after his birth.

The young boy was born in May 1999 with a congenital heart defect which required a shunt procedure performed at Advocate Christ Medical Center/Hope Children's Hospital in Oak Lawn, Illinois. Two weeks after being sent home, the parents returned the infant to the emergency room.

The lawsuit alleged his left leg had to be amputated due to mistakes made in the operating room. The child also suffers from cognitive deficiencies and developmental delays alleged to be caused by the delayed treatment and cardiac catheterization.

The jury found the hospital and staff were negligent in failing to diagnose the infant's shunt problems in time and subjecting him to an unnecessary catheterization.

Pennsylvania Couple Awarded $2.4 Million In Medical Malpractice Suit

The Olean Times Herald reports a jury has awarded $2.4 million to a 47-year-old woman and her husband for "ill-advised" surgery in 1998.

In October 1998, the woman went to Olean General Hospital emergency room with abdominal pains. She was diagnosed with an obstructed bowel and was admitted for "conservative medical management." Her condition improved and her gastroenterologist and surgeon (Dr. Chohan) agreed to keep her on the treatment plan.

The next day, while the gastroenterologist was out of town, Dr. Chohan decided to perform surgery and removed more than 12 inches of her bowel. She spent 88 days in the hospital following the surgery, was readmitted to three hospitals, and underwent two other surgeries for infections and complications from the original surgery.

As a result of her trauma, the woman is on daily pain narcotics and has difficulty controlling her bowels.

$4.34 Million Awarded To Veteran Paralyzed After Spinal Surgery

A 66-year-old veteran who alleged he was left paralyzed from spinal surgery at the Veterans Administration Medical Center in West Los Angeles has been awarded $4.34 million by a federal judge, according to Courthouse News Service.

In October 2005, Alvin Johnson had spinal surgery to correct a ruptured disc at the VA medical center, according to the article. Doctors injected Surgifoam, a material which absorbs blood and other fluids, into the space created once the ruptured disc was removed.

According to the complaint, the doctors did not remove all the excess foam and it expanded, pressing against the spinal cord. When the veteran's daughter was notified two and a half hours later, Mr. Johnson had no feeling from his neck down and was nearly completely paralyzed.

An MRI showing the spinal cord was compressed was ordered by another doctor, but Mr. Johnson's doctors did nothing, the veteran's complaint alleged. The complaint also alleged that had corrective steps been taken, permanent damage could have been prevented. Mr. Johnson is now totally dependent on others and confined to a bed or wheelchair.

$11.1 Million Awarded To Family Of Nine-Year-Old In Medical Malpractice Lawsuit

A Florida jury has awarded $11.1 million to the family of a 9-year-old boy in a medical malpractice case filed against All Children's Hospital, reports the St. Petersburg Times.

In August 2000, the boy -- then 3 months old -- was taken to the hospital after being sick for days with vomiting and diarrhea, according to the family's lawsuit. After about four hours, the mother was told he was fine and she could take him home, the article reports, but the next morning, he was rushed back to All Children's Hospital when he had trouble breathing.

The lawsuit alleged the hospital and the medical staff did not properly check the child for dehydration on the first visit and thus did not treat him for dehydration causing him to suffer from irreversible brain damage.

A doctor, who was considered to be 40 percent responsible for the boy's condition, has settled out of court for an undisclosed amount, the article states.

Alleged Hospital Error Using Fentanyl Patch Fatal To Autistic Teen

A wrongful death lawsuit alleges a 15-year-old Autistic boy died in March when he was given a Fentanyl patch to alleviate his pain from a routine tooth extraction, reports Seattlepi.com.

Seattle Children's Hospital sent Michael home with his mother on March 9, following the extraction, with the fentanyl patch for pain, according to a civil suit filed earlier this month in Washington's King County Superior Court. Family members found him unresponsive the next morning and paramedics were unable to revive him - he was pronounced dead at his home.

The medical examiner report states the boy died from a drug overdose caused by the fentanyl patch, which is usually used for patients with chronic pain such as cancer patients, the newspaper reports.

Children's Medical Director has admitted the hospital staff erred when if prescribed the fentanyl to Michael, according to the article. The hospital now has a system in place to prevent such tragedies, which it did not have at the time Michael was given the patch.

The FDA has warned against the misuse of the patch system since 2005 and in a recent public health advisory warned against prescribing the patch in situations identical to Michael's, the article stated.

The civil lawsuit against the hospital was filed by Michael's mother.

$3.7 Million Awarded To Family After Farm Worker's Death

The Green Bay Press Gazette reports a Brown County, Wisconsin jury has awarded the family of a farm worker $3.7 million in their medical malpractice lawsuit.

The worker died after contracting a fungal infection called blastomycosis. On two separate occasions in December of 2003 the man sought medical treatment at the Bellin Family Medical Facility. The physician assistants misdiagnosed him as having pneumonia without running basic diagnostic tests, including x-rays. In late December, he was admitted to another hospital where he was correctly diagnosed, but it was too late to save his life.

The jury found Bellin Health System and Dr. Peri Aldrich, who oversees the physician assistants, negligent and awarded his wife and two young children $3.7 million.

Medical Malpractice Lawsuit Filed In Death of 16-Year-Old Patient

According to The Cincinnati Enquirer, the estate of a 16-year-old girl has filed a wrongful death lawsuit against a neurosurgeon who allegedly tried to cover up mistakes he made while performing brain surgery on the girl by interfering with her autopsy.

In 2006, the girl underwent surgery to prevent veins in her brain from knotting - a condition resulting from a birth defect, the newspaper reports. She died nine days later. The girl had previously undergone this procedure several times with no problems.

After her death, her father requested a complete autopsy. It was performed the following day, but it did not include the head or the brain. The neurosurgeon told the family the autopsy did not reveal the reason for the girl's death and denied knowing that the head and brain were excluded from the autopsy, the newspaper said.

During deposition testimony for a separate lawsuit, a nurse testified the neurosurgeon agreed to a complete autopsy, but after the father left the room, he ordered the autopsy should omit an examination of the brain, the article states.

The lawsuit filed against Dr. Andrew Ringer and the Mayfield Clinic & Spine Institute alleges a complete autopsy would have shown the doctor's mistakes and that these mistakes contributed to her death. The lawsuit claims the doctor ordered the change “in an attempt to avoid his medical negligence liability and to avoid the possibility of a legal action against him.”

According to the Temple Daily News Telegram (Texas), a 45-year-old woman is suing Scott & White Memorial Hospital for medical malpractice alleging negligence resulted in multiple surgeries and a lifelong debilitating condition.

The once active woman has been an inpatient for 740 days since her surgery, she alleges, and she maintains medical expenses have cost her over $2.5 million and could reach over $30 million throughout her life.

Due to abdominal adhesions, her primary care doctors had decided she should never have abdominal surgery unless absolutely necessary, according to her complaint. In 2007, doctors at Scott & White performed abdominal surgery, causing multiple injuries, and resulting in an infection in her blood, she all alleged, and she has since had at least 22 surgeries to repair the damages from that surgery.

The IndyStar reports a jury has awarded $5 million to a woman whose ruptured diaphragm was misdiagnosed as a urinary tract infection at Methodist Hospital in 2000. Her attorneys claim this happened through a series of miscommunications about her x-rays.

$2.1 Million Awarded in Medical Malpractice Case

The Milwaukee Journal Sentinel reports a jury has awarded $2.1 million to a man for injuries he suffered nine years ago during treatment following a devastating motorcycle accident.

The man and his wife were injured when a car pulled out in front them, throwing them both from the motorcycle they were riding. The wife spent 10 days in the hospital before being released and the husband spent 13 months in rehabilitation at Froedtert Hospital.

While in rehab, the man had an emergency involving his tracheotomy tube and Dr. Lorraine C. Novich-Welter was called in. The lawsuit alleged the doctor waited too long to call an emergency team for assistance, leaving the patient with life long disabilities.

The jury ruled that the doctor was negligent in the medical care she provided. The hospital and other medical personnel were not found negligent.

Before the accident, the patient had been a restaurant owner for 20 years and both he and his wife had been competitive runners. He is now confined to a wheelchair.

Dakota Urology Clinic Sued for $5 Million in Medical Malpractice

Five plaintiffs are asking for $5 million in damages from the Siouxland Urology Center in Dakota Dunes, SD. claiming negligence, medical malpractice, and intentional infliction of emotional distress.

In the 22 page class-action lawsuit the patients claim Siouxland Urology breached the standard of care by re-using certain disposable medical equipment which caused damages to the patients. Manufacturers recommend the equipment used in cystoscopy procedures be used only once. Siouxland Urology denies any unsterilized equipment ever came into direct contact with patients.

South Dakota Department of Health has ordered the Center to change its cystocopy practices and the Center is offering free blood test to check for HIV and Hepatitis for the 5,200 affected patients.

California Revokes Plastic Surgeon's License

The Medical Board of California has made public a decision made in December that a Torrance, CA. plastic surgeon is no longer allowed to practice medicine. According to the Torrance Daily Breeze, Dr. Lawrence Saks is also under federal indictment for several alleged crimes, including insurance fraud.

The Medical Board found that Saks committed "acts of gross negligence; repeated negligence failed to maintain adequate and accurate medical records in the case and treatment of two patients; failed to maintain malpractice insurance, and failed to timely report a patient’s death". The patient died after a liposuction at Saks' outpatient clinic when she went into cardiac arrest due to lack of oxygen to the brain. Saks was acting as both the surgeon and the anesthesiologist and the board found he did not monitor his patient properly during the procedure, having his attention divided creating suboptimal conditions for both tasks.

The trial on federal charges for about $4 million in insurance fraud is scheduled to begin in May.

$7.5 Million Awarded In Breast Cancer Medical Malpractice Case

A Spotsylvania County jury has awarded what is believed to be one of the largest malpractice recoveries -- $7.5 million -- in Virginia history to the family of a woman who died after a misdiagnosis of breast cancer.

This is also the second largest malpractice award against Dr. Donna Gamache, reports the Free Lance-Star.

In 2003, the 53-year-old woman found a 1 inch by 2 inch lump in her breast and went to Dr. Gamache’s office. A mammogram was negative. The lawsuit argued the doctor should have ordered more tests to properly diagnose the lump and should have not relied on the false-negative mammogram. When the patient returned to the doctor seven months later, she was diagnosed as Stage IV and the cancer was incurable. The woman died in 2006.

The award will be reduced to $1.65 million: the state-mandated malpractice cap at the time of the negligence.

College President Who Filed Medical Malpractice Lawsuit Dies

The president of Amarillo College, who in December 2008 filed a lawsuit for medical malpractice over alleged negligent treatment of his cancer, has died.

Steve Jones passed away on Feb. 22, according to The Amarillo Globe News (Amarillo.com). In his lawsuit, Jones alleged Amarillo Urology Associates failed to properly treat a cancerous tumor in his abdomen in 2007, resulting in his "impending death." According to the suit, the patient had been told the surgery was a "complete success."

The suit alleges the doctors spread a cancerous tumor during surgery to remove a potentially malignant tumor in the kidney and failed to provide proper follow-up visits that could have discovered the president's condition. The suit also listed the president's wife, two children, and mother as plaintiffs but did not specify an amount for damages.

Florida Doctor Loses Medical License

The Board of Medicine has revoked the license of a Florida doctor over alleged medical malpractice, delegating responsibility to unlicensed personnel, and failing to keep an accurate medical record, according to the Associated Press.

The Department of Health recommended the license of Dr. Pierre Jean-Jacque Reneliqu be suspended. The board decided to revoke it over his treatment of a teenage girl at his Hialeah clinic. That means he cannot practice medicine in the state of Florida. The Miami-Dade State Attorney’s Office is investigating if criminal charges should be filed.

Study: Avastin Increases Risk Of Blood Clots

Users of the cancer drug Avastin may be at an increased risk of Venous Thromboembolism, according to a new report in the Journal of the American Medical Association.

The study looked at 8,000 patients and found that 8.3 percent of Avastin users developed venous blood clots, compared with 6.1 percent patients in a control group. Blood clots are among the leading causes of death in cancer patients, the study noted.

U.S. patients suffer more medical errors

U.S. patients suffer the highest medical errors, coordination problems and out-of-pocket costs compared to seven other countries, according to a new non-profit report.

The 2008 survey looked at 7,500 chronically ill patients in Australia, Canada, France, Germany, the Netherlands, New Zealand, Britain and the United States.

N.J. Patient Awarded $25 Million Over Misdiagnosis That Caused Brain Injury

A New Jersey jury has awarded $25 million to a patient who suffered severe brain damage after his headaches were misdiagnosed.

NY Jurors Award $6.5 Million Medical Malpractice Verdict

Emergency Room Patients Now Waiting Nearly an Hour For Aid

A New Jersey man who alleged that laser eye surgery by a prominent eye surgeon actually worsened his vision has agreed to settle his lawsuit for $2.1 million. The man’s lawyer says his client is now legally blind but the surgeon disputes that, saying he has functional vision with contact lenses.
