Family Accepts $5.2 Million After Caesarean Section Death

The family of a 32-year-old woman who died following child birth in 2007 has accepted $5.2 million from two doctors and the Albany Medical Center Hospital, reports the Albany Times Union.

After a normal and healthy pregnancy, the mother bled to death following a Caesarean section, the newspaper reported, despite several calls to her primary obstetrician stating she was bleeding internally. After the third call, the doctor finally came to operate on the patient but was too late to save her life, the article stated.

Instead of going to trial in August, family members accepted the settlement because they could not have won non-monetary stipulations in a trial. These stipulations require the hospital to take specific steps to enhance patient safety.

Family Receives $492,000 For Cancer Misdiagnosis

Fox News reports the family of a 23-year-old British mother of two was awarded $492,000 after she died from an aggressive cancer.

The mother was sent home on several occasions from the hospital when doctors claimed there was nothing wrong with her, but that she needed psychiatric attention because she was imagining her illness. She died four weeks after her last hospitalization from peritonitis and malignant non-Hodgkins lymphoma.

The young woman became ill in May 2004. In February 2005, she had exploratory surgery which revealed fluid above the liver. She was admitted three more times to the hospital with another surgery following on March 7, 2005. This surgery revealed an extensive malignant tumor. She later suffered a ruptured bowel causing peritonitis which lead to multi-organ failure. She died on March 24.

Woman Left Paralyzed After Surgery For Broken Leg Awarded $22.26 Million

A 62-year-old woman and her husband in Tennessee have been awarded over $22 million by a federal jury after she was left paralyzed from the waist down following surgery for a broken leg, reports the Chattanoogan.com.

The lawsuit was filed in April 2007. Over $19 million was awarded in favor of the woman, and $3 million was awarded to her husband.

$23.2 Million Awarded In Birth Injury

The West Central Tribune reports a Kandiyohi County (Minnesota) jury has found Rice Memorial Hospital and Affiliated Community Medical Centers negligent, and awarded $23.2 million to a Paynesville family and their severely handicapped daughter.

Deprived of oxygen during her birth, the girl suffers from spastic quadriplegic cerebral palsy, cortical impairment, neurological difficulties and seizures. Even though the jury did find for the defendants on the issue that the mother was informed of the risks of inducing labor and of vaginal delivery, they found the Medical Centers 80% accountable and 20% to the city-owned hospital.

The award includes $1.7 million for past health care expenses, $10 million for future health care expenses, $10 million for past and future pain, disability and emotional distress, and $1.5 million for loss of earning capacity.

University of Pittsburgh Medical Center Sued Following Liver Transplant

Two brothers have filed separate lawsuits against the University of Pittsburgh Medical Center (UPMC) alleging they were not fully informed about the risks of a live-donor liver transplant. Since the surgery, they both have suffered complications, reports USA Today.

In 2007, the 43-year-old brother from the state of Washington donated part of his liver to his 45-year-old brother from California who suffered from liver disease. Each lawsuit claims the medical center and the former chief of transplantation made the live-donor surgery seem safer than it was.

The lawsuits cite results from studies published by the Pittsburgh Tribune-Review which showed 66 percent of the 121 liver live-donor transplants at UPMC from 2003 to 2006 resulted in major complications.

UPHC has declined comment.

Hospital To Pay $1.55 Million In Woman's Death

Hartford Hospital will pay $1.55 million to the family of a woman who died in their emergency room, reports Connecticut's Eyewitness News.

In March of 2004, a wife and mother sought medical help at the emergency room of Hartford Hospital, complaining of chest pain, vomiting and diarrhea. Doctors discharged her and told her she was fine and could go home.

She insisted on seeing another doctor and waited to see a cardiologist. She was found unconscious and unresponsive seven hours later when doctors finally checked on her.

She leaves behind a husband and two sons under the age of 12.

Dakota Urology Clinic Sued for $5 Million in Medical Malpractice

Five plaintiffs are asking for $5 million in damages from the Siouxland Urology Center in Dakota Dunes, SD. claiming negligence, medical malpractice, and intentional infliction of emotional distress.

In the 22 page class-action lawsuit the patients claim Siouxland Urology breached the standard of care by re-using certain disposable medical equipment which caused damages to the patients. Manufacturers recommend the equipment used in cystoscopy procedures be used only once. Siouxland Urology denies any unsterilized equipment ever came into direct contact with patients.

South Dakota Department of Health has ordered the Center to change its cystocopy practices and the Center is offering free blood test to check for HIV and Hepatitis for the 5,200 affected patients.

California Revokes Plastic Surgeon's License

The Medical Board of California has made public a decision made in December that a Torrance, CA. plastic surgeon is no longer allowed to practice medicine. According to the Torrance Daily Breeze, Dr. Lawrence Saks is also under federal indictment for several alleged crimes, including insurance fraud.

The Medical Board found that Saks committed "acts of gross negligence; repeated negligence failed to maintain adequate and accurate medical records in the case and treatment of two patients; failed to maintain malpractice insurance, and failed to timely report a patient’s death". The patient died after a liposuction at Saks' outpatient clinic when she went into cardiac arrest due to lack of oxygen to the brain. Saks was acting as both the surgeon and the anesthesiologist and the board found he did not monitor his patient properly during the procedure, having his attention divided creating suboptimal conditions for both tasks.

The trial on federal charges for about $4 million in insurance fraud is scheduled to begin in May.

Florida Doctor Loses Medical License

The Board of Medicine has revoked the license of a Florida doctor over alleged medical malpractice, delegating responsibility to unlicensed personnel, and failing to keep an accurate medical record, according to the Associated Press.

The Department of Health recommended the license of Dr. Pierre Jean-Jacque Reneliqu be suspended. The board decided to revoke it over his treatment of a teenage girl at his Hialeah clinic. That means he cannot practice medicine in the state of Florida. The Miami-Dade State Attorney’s Office is investigating if criminal charges should be filed.

Virginia Doctor Could Lose License After Multiple Patient Deaths

Dr. Stephen Plotnick of Virginia Beach, Va. could become one of Virginia’s 25,000 doctors to receive the stiffest penalty issued by the Virginia Board of Medicine – the loss of his medical license, reports The Virginian Pilot.

Dr. Plotnick faces a hearing this week before the Virginia Board of Medicine -- which suspended his license in August -- to decide if he will be able to keep practicing medicine.

According to the news story, Dr. Plotnick is known for his aggressive treatment of fibromyalgia by using powerful narcotics. At least five of his patients have died of overdoses while others were hospitalized for severe depression and addictive symptoms. Dr. Plotnick has been named as the defendant in six malpractice suits. One of the cases has been settled.

FDA Warns Of Interference With Medical Devices During CT Scans

The FDA has issued a new warning on CT scans for patients with pacemakers, defibrillators, insulin pumps and other devices. Those electronic devices can malfunction when people get computerized tomography (CT) scans, the FDA said.

The agency has received six confirmed reports of devices that malfunctioned after a CT scan and another nine reports of suspected problems, FDA spokeswoman Karen Riley said. There have been no reports of deaths.

Experts Call For Further Study Of Imaging Contrast Agents

A U.S. panel of medical experts this week called on the makers of contrast agents, which are used to enhance heart images, to conduct larger studies to better evaluate the risks. The Food and Drug Administration imposed warnings late last year on imaging agents made by two companies. That followed 200 reports of complications, including seven deaths. However, the FDA relaxed the restrictions earlier this year after doctors said medical benefits of the contrast agents outweighed their side effects. About 22 million heart ultrasounds were conducted in the United States in 2005.
