BP Ordered To Pay $100 Million To Workers Exposed To Toxic Materials

KWTX reports a federal jury in Texas awarded 10 workers $10 million each in punitive damages after being injured at BP PLC's Texas City plant.

In the lawsuit the workers claimed the BP plant released a toxic substance which caused their injuries. More than 100 workers were sent to area hospitals in April 2007, claiming they were exposed to the toxic substance released by the refinery.

BP officials deny the workers were harmed and are said to be shocked by the verdict.

$16 Million Awarded in Industrial Accident Settlement

The Philadelphia Daily News reports the owner of a landfill and Caterpillar Inc. have agreed in Philadelphia Common Pleas Court to pay one of the largest settlements in Pennsylvania history for a single-victim personal injury case.

The companies have agreed to pay $16.25 million to a man whose legs were crushed by a bulldozer three years ago.

On May 1, 2006, the man was working his fifth day on the job as a truck spotter at the Chrin Sanitary Landfill, when a massive track loader backed around a pile of garbage and ran him over, crushing his legs.

He developed serious infections due to the garbage that had been crushed into his wounds. His right leg, part of his right hip, and most of his left leg had to be removed.

The lawsuit claimed the owners of the landfill had not trained the victim sufficiently and the Caterpillar didn’t have adequate rear vision.

$743,000 Awarded In Texas Personal Injury Case

A former BP security guard who tripped and fell, breaking both feet, when walking out of a portable toilet four years ago has been awarded $743,000 for her injuries by a Galveston jury, according to Galveston County’s The Daily News.

In 2005, the guard tripped outside the toilet near the BP chemical docks on a grate that she alleged was not installed properly. The woman alleged she suffered a permanent disability due to the accident and can no longer work as a security guard and is now driving a school bus.

$7 Million Awarded In Wisconsin Construction Accident

A Wisconsin man, permanently injured in a construction accident at a Quad City hotel, has been awarded more that $7 million.

The subcontractor was working on the gutters at the Holiday Inn Express Hotel in Leclaire, Iowa in 2005 when a lift tipped over and he fell 3 stories.

According to testimony during the trial, 8 different OSHA violations were found at the construction site. The lawsuit was filed against Leclaire Hotel Group LLC and Gibbs Construction and is possibly the largest individual award in Scott County history.

Construction work is one of the deadliest civilian jobs in the U.S., with the nation’s third-highest rate of fatalities. Ford Motor Co. to Pay $3.6M in Mesothelioma Case

A woman who contracted mesothelioma after second-hand contact with asbestos has been awarded $3.6 million by a Florida jury. Lynda Daly worked for a Ford dealership in the 1970s,where she claims she was exposed to asbestos-filled brakes. She also believes that she may have ingested the asbestos because her husband repaired brakes at home. Mesothelioma is a form of cancer caused by asbestos exposure. It generally kills its victims within two years of detection.

Sanford Backs Off On Use Of AMA Standards In Workers’ Comp Cases

Gov. Mark Sanford has backed away from efforts to force the state Workers’ Compensation Commission to accept new injury payment standards. Last fall, Sanford issued executive orders for the commission to use the AMA-backed guidelines, or similar ones, arguing the AMA standards were a way to cut workers’ compensation costs by linking awards to objective criteria while reducing the role of attorneys. He later asked the Supreme Court to decide the issue. Opponents argued the AMA standards didn't take into account the type of work people perform.
