The Palo Alto Daily News reports the city of Palo Alto will pay $1.5 million to a man injured in a vehicle crash in 2006. The victim alleged a city worker failed to stop for a red light because he was reaching for his cell phone, resulting in a rear-end collision which left the plaintiff with debilitating spinal injuries. The victim had asked for more than $5 million from Palo Alto.

This is the largest payout for the city for a personal injury claim in recent history. The driver of the city vehicle is no longer employed by the city.

$7 Million Awarded To Woman Hit By Metro Van

The Seattle Times reports King County has agreed to pay what is believed to be the largest amount the county has ever paid a single plaintiff - $7 million to a woman hit by Metro van.

In November 2007, the woman was riding her Vespa scooter to work as an operating room nurse when she was struck by the Metro van. The driver failed to yield the right of way at a stop sign.

The impact with the van caused the woman to be thrown 40 feet, suffer severe internal injuries and compound leg fractures. She was in a coma for several days following the accident and has not been able to return to work.

$8 Million Awarded In Transit Bus Personal Injury Suit

A 34-year-old research librarian has been awarded $8 million by a Richmond, Virginia jury for injuries she suffered when struck by a GRTC Transit System bus in 2007, reports the Richmond Times-Herald.

The librarian suffered spinal and shoulder damage as well as hip and pelvis fractures when she was struck by the bus which made a right hand turn as she was crossing the street beside the Library of Virginia. She will probably need multiple hip replacement surgeries before she turns 50-years-old.

The bus company originally offered a $1.8 million settlement. The $8 million awarded was the full amount requested in the case.

Tavern To Pay $500K In Teen's Death

A Jersey County, Illinois, jury ruled that Thirsty's Tavern should pay the family of a 19-year-old girl who died in an alcohol-related accident, more than half a million dollars, reports the Journal-Courier.

The girl was a passenger on a motorcycle driven by a 24-year-old boy who had been drinking at the tavern for several hours before the accident. The driver was also killed in the accident.

The lawsuit claimed the young man's drinking at the tavern owned by his father, caused his intoxication which was one of the causes of the girl's death. Toxicology reports showed no alcohol in the young girl's system while the young man's was almost double the legal limit for Illinois.

Judgment limitations under Illinois' Dramshop Act will limit the award to closer to $100,000.

Wrongful Death Lawsuit Filed In Auto Accident Death

The Watertown (NY) Daily Times reports the estate of a 54 year-old woman has filed a wrongful death lawsuit after the woman died as a result of a two-vehicle accident in the town of LeRay.

The woman's car was hit by a van as she entered an intersection with a missing stop sign. The lawsuit names the driver of the second vehicle for negligence for failing to avoid the crash, for speeding, and for failing to slow down at an intersection.

The town of LeRay was also named for negligence for not properly maintaining the stop sign. The sign had been missing long enough that it should have been replaced by the town. The amount being sought in the lawsuit is not known.

New Jersey Verdict of $6 Million When Tree Limb Falls On Car

What is reported to be one of the largest verdicts in Hunterdon County has been awarded to a Delaware Township man for injuries suffered when a large tree limb fell on his car in 2006, reports nj.com.

Kenneth Matlock and his wife suffered broken necks when a limb from an oak tree fell onto their car from a height of about 20 feet. Mr. Matlock is permanently disabled from the incident.

The DOT was found to be responsible since the tree was in the state's right-of-way. The tree was thought to have been weakened from recent flooding and rot. The lawsuit claimed the defendants failed to maintain the property next to the road and failed to warn drivers of the tree hazards which they knew of and failed to fix.

There had been 55 reports of tree-related incidents in the area in the 2 years prior to Matlock's accident. The jury was unanimous in agreeing the DOT was negligent for not removing the tree.

$166,000 Awarded To Woman Injured By Drunk Driver

Georgia Gainesvilletimes.com reports a Hall County jury has awarded $166,000 to a 57-year-old woman who suffered serious injuries in a car crash caused by a drunk driver in 2007.

The drunk driver's Tahoe struck a Honda Civic with such force it was knocked into the woman's PT Cruiser, causing an open compound fracture to her ankle, according to the article, which states the woman continues to have pain and loss of motion in that ankle. The passengers in the Honda were also injured -- one had to be airlifted to a hospital.

The drunk driver had only minimum insurance which went to the family in the Honda. The injured woman had underinsured motorist coverage but chose to let the jury decide the amount she should receive for her injuries, the article states.

$49 Million Awarded In California Personal Injury Lawsuit

One of the country's largest personal injury verdicts was awarded to a former college student who is permanently brain damaged after a 2007 automobile accident, reports the Mercury News. The Santa Clara jury found two truckers and state transportation officials at fault in the accident.

On May 3, 2007, the victim was in the back seat of a car heading for a camping trip with three other men when two trucks collided, sending one into the rear of the men's car. The accident left the 23-year-old college student with permanent brain damage requiring full-time care at a neurological treatment center.

Out of court settlements will bring the total damages to more than $60 million, which will be used for the man's care and rehabilitation.

$500,000 Awarded To Woman Hit By Police Car

The Oregonian reports the most expensive verdict in the history of the city of Beaverton has been awarded to a 27 year-old pedestrian hit by a police car in February, 2007. The town will pay $507,500.

The accident happened when the woman and her brother were trying to cross a highway at an unmarked crossing used by transit riders. The pair saw headlights in the distance but thought they had enough time to safely cross. The police officer told investigators all he saw was a pair of white shoes, tried to slow down then hit something.

The woman suffered injuries to her left leg, collar bone, back, hip, and ribs. She still walks with a cane and has not been able to return to work.

Tribal Court Awards $2.9 Million In Personal Injury Lawsuit

Indian Country Today reports what may be the largest personal injury claim ever in a tribal court has been awarded to a man who lost his leg in a 2006 accident.

In November, 2006, the man and his wife went to the Foxwoods Grand Pequot Hotel to celebrate their 45th wedding anniversary, according to the article. The husband was unloading the trunk of his car when a runaway car started by a valet, crashed into him. The valet had intended to turn to turn the key to the accessory position in order to lower the windows but turned the car to "start" instead. The car lunged forward, crushing the man against his car, then knocked him to the pavement and pinned him underneath.

The lawsuit claimed the Mashantucket Pequot Gaming Enterprise, owner of the hotel, was liable for not properly training its employees.

$4.4 Million Awarded to Family in Automobile Wrongful Death Case

A Utah 4th District Court jury has awarded the family of a man killed in a traffic accident in 2006 almost $4.4 million, reports The Salt Lake Tribune.

Due to state law caps on damages against the state and the victim's share of the responsibility, the award will be reduced by almost $2 million.

The family of the Payson man sued the state Department of Transportation and a subcontractor for failing to post appropriate signs warning of traffic delays as they were working on the reconstruction of a bridge. The man was killed as he came over the crest of a hill and tried to swerve to miss the driver ahead of him who slammed on his brakes to avoid hitting cars stopped because of the bridge project. He crashed his vehicle and died 13 days later.

The jurors awarded almost $3 million for economic damages and $375,000 each for the man's wife and three children.

Lawsuit Filed In Automobile Crash

A 46-year-old woman who suffered spinal and other injuries resulting in the amputation of her right hand as a result of an automobile accident has filed a $10 million lawsuit against the other driver, reports The Times of Northwest Indiana.

The lawsuit names the driver of a Walker's Specialized Logistics pick-up truck claiming he was impaired at the time of crash and was suffering from a known medical condition. The owner of the truck and Walker's Specialized Logistics were also targeted stating they knew or should have known the driver was incapable of driving the truck safely.

Witness accounts state the pick-up truck struck a van, then turned to go in the opposite direction where he struck five other vehicles before ending up in a ditch.

The Maine Morning Sentinel reports a judge has awarded a Readfield woman close to $1.5 million for injuries suffered in a 2006 auto accident.

Paralyzed Florida Truck Driver Awarded $14.6 Million

A Broward County, Florida Circuit Court judge has awarded $14.6 million to a 64-year-old truck driver crippled in a 2007 wreck, reports the Insurance Journal.

The truck driver was hauling sugar in 2007 in Palm Beach County when a driver ran a stop sign, causing him to swerve to avoid an accident which would have likely killed the other driver. The trucker's 18-wheeler left the road and overturned, leaving him paralyzed.

National Casualty Co. denied the trucker's claims. He then sued for uninsured-motorist benefits to help pay his medical bills.

The company is expected to appeal the judge's award.

$80 Million Settlement In Hurricane Rita Bus Fire Lawsuit

The Houston Chronicle reports an $80 million settlement for the families of 23 Bellaire nursing home residents who died in a bus fire while evacuating from Hurricane Rita in September 2005.

Sunrise Senior Living Services of McLean, Va., owners of Bellaire, ordered evacuation of the facility to a sister facility in Dallas the week before Hurricane Rita. While in route to Dallas, the bus caught fire and the 23 residents died, The National Highway Traffic Safety Administration later determined the probable cause of the fire was insufficient lubrication of a rear axle. The axle overheated, causing a fire which quickly filled the bus with flames and heavy smoke.

The settlement includes an agreement to end a lawsuit against the nursing home’s corporate owner.

Jury Awards $10.5 Million To Motorist Hit By Dump Truck

A California jury has awarded $10.5 million to a Fresno motorist who suffered severe head and brain injuries after she was struck by a dump truck driver who had been drinking.

Study: Truckers With Health Problems Causing Fatal Wrecks

Thousands of tractor-trailer and bus drivers in the United States carry commercial licenses even though they also qualify for full federal disability payments, according to a new safety study. Some of those drivers have suffered seizures, heart attacks or other serious health problems while driving, leading to deadly crashes, according to the study.

The federal Transportation Department said 5,300 people died in crashes involving large commercial trucks or buses in 2006, and another 126,000 were injured.

The 30-page study said more than 560,000 commercial drivers were also eligible for full disability benefits over health issues. More than 1,000 drivers had vision, hearing or seizure disorders which would normally prohibit a trucker from obtaining a valid commercial license.

CA Court To Review Rollover Verdict

The California Supreme Court will review an $82.6 million verdict awarded after a 2002 rollover accident left a woman paralyzed. The city of Chesapeake, Va. has agreed to pay $4.3 million to settle a federal lawsuit filed on behalf of two North Carolina teens injured in a 2006 crash. The teens were severely injured when an SUV going the other way swerved off the road, damaged a tire because of a deep rut and crashed into their Mustang, according to an attorney in the case. He said city officials knew about the rut but failed to repair it.

Tabor City Crash Racks Up Mighty List of Charges

Driving while impaired. Felony hit-and-run. Open container in vehicle. Driving with a revoked license. Felony speeding to elude arrest. Running a stop sign.
